Is my auto repair shop liable for hail damage while parked on their lot?

My car was parked in the lot of my dealership while in for warranty repair. A severe hail storm caused significant hail damage to the vehicle. Should the dealership’s insurance pay for the repairs, or at least my deductible if I file under my insurance?

Depending on where you live they could be responsible for not taking care of your vehicle in a proper and safe manner.

If I were you I’d contact your insurance company and the auto club if you’re in one and see what they have to say.

I don’t think they would be responsible unless you can show that the damage to your car could have been reasonably avoided or was caused by their negligence.

Many insurance policies exclude damage by “acts of God” like hail anyway.
